By the grace of Hashem,
24 Tevet. I am responding to your letter of 20 Tevet [1]:
A) Citing tractate Bava Kamma* 9b, you indicate that a better way of accomplishing the Mitzvah could be the one that adds a third [2] and the best way, that which allows one to exceed this third, a particular reward then being granted by Hashem.
In my humble opinion, this conclusion is not exact, as I stated in my previous letter. Indeed, no Talmudic reference introduces a distinction comparable to the one that exists for the Chanukah lights. We therefore cannot define several categories, so that less than a third and more than a third indeed belong to the same one and are, both of them, deduced from the same verse "He is my L-rd and I want to be gracious before Him" through the accomplishment of the Mitzvos.
Thus, we have seen that one determines five categories of oils for the offerings. We do not deduce from this that there are five ways of accomplishing the Mitzvah, and it is the same for all the other Mitzvos, as I noted in my previous letter.
One therefore fulfills the obligation of bringing oil for the offerings by taking the best of what one has available. And, it is the same for the reference you cite in tractate Bava Kamma. It requires, when one must accomplish a Mitzvah, to take the best of what one possesses, even if this leads to adding less than a third.
It is not the same for the Chanukah lights. For what concerns them, the one who wants to accomplish the Mitzvah in a better way is not required to choose the best way, since these are two different categories.
Tractate Bava Kamma makes a difference between less than a third and more than a third to determine whether the man should receive a reward in his lifetime, but not to determine how he fulfills his obligation. This is also the opinion of the Rashba*.
One may, nevertheless, question the commentary of Rabbeinu Chananel*, who seems to introduce this distinction also regarding the strict obligation imposed by the Torah.
Although, in his commentary on tractate Bava Kamma, Rabbeinu Chananel cites the example of the Chanukah lights, one cannot think that he intends to define, here too, a better way and the best way. Moreover, he gives a second explanation establishing that this is not the case.
He therefore only illustrates the statement of the Gemara*, regarding better accomplishing the Mitzvah.
To my knowledge, there is no other passage of the Talmud Bavli* evoking a better application of the Mitzvah.
B) You wonder whether the fruits of the Mitzvah of benevolence are consumed in this world, once the law has been strictly applied, or only when it has been done in the better way.
The first interpretation is the correct one.
C) You equate these fruits consumed in this world with the contribution, for Hashem, of a Mitzvah accomplished in the best way. This is not exact and one must distinguish them for the following reasons:
1. These fruits are not necessarily consumed in the domain where the Mitzvah was accomplished. Thus, the one who devotes his money to honoring his parents does not receive the certainty that his financial loss will be compensated. For, of this Mitzvah of honoring one's parents, it is only said: "so that you may know the good."
Certainly, tractate Kiddushin* 31a relates that Dama Ben Nesina received, the following year, all the money he had lost. This does not mean that this is systematically the case and, in fact, the verse says only: "so that you may know the good."
Conversely, the Mitzvah is accomplished in the best way for Hashem, Who therefore compensates the financial loss that may result from it. Thus, the promise is made for the expenses of Shabbos, of the festivals, or those whose purpose is to ensure the Torah study of children, as the Talmud specifies.
2. To say that the Mitzvah is accomplished in the best way implies only that Hashem compensates the lack [3] created in this way [4], that is to say the expense incurred.
Conversely, the consumption of the fruits of which the Mishnah* speaks brings life, justice and honor. It is the same for all these Mitzvos. In such a case, the fruits are much more numerous than the effort invested [5].
Moreover, equating these fruits with the portion given to Hashem would raise a difficulty in understanding the Tosafos, in tractate Bava Kamma, who clearly ask to distinguish them.
One must conclude that the fruits have no other purpose than to compensate the lack caused by the accomplishment of the Mitzvah, whose principal remains preserved for the World to Come. This also allows one to exclude the second explanation of Rabbeinu Chananel, according to which the portion of Hashem is not directly linked to the reward of the Mitzvah. The Tosafos, at this reference, therefore only cite the Mishnah.
This interpretation of the Tosafos allows one to deduce two clarifications:
1. In tractate Kiddushin, it is said that these fruits are granted only for the Mitzvos accomplished toward other people, whereas the Mitzvah of the esrog, for example, is put into practice for Hashem.
2. Moreover, the list that the Mishnah draws up of what procures fruits in this world is exhaustive, as the tractates Shabbos and Kiddushin state. Now, it does not mention the accomplishment of the Mitzvah in the best way, for more than a third.

ב"ה, יום כ"ד טבת תש"ד
במענה על מכתב כת"ר מיום כ' טבת.
א) מה שהעיר מב"ק (ט, ב) די"ל דהידור מצוה עד שליש הוא בדוגמת מהדרין ויותר משליש הוא בדוגמת מהדרין מה"מ, ולכן שכר מיוחד הוקבע לו שהוא משל הקב"ה.
הנה לפענ"ד אינו כן, וכמ"ש גם במכתבי הקודם, דכיון דלא אשתמיט הש"ס לחלק בההידור גופא שיש הדור והדור מהמ"ה עדמ"ש בנ"ח, אין לנו יסוד והכרח לחלקו לסוגים, ובפרט שהן שליש הן יותר משליש - המחייבים אחד הוא (פסוק דזה א-לי גו' התנאה לפניו). וכמו שלא נאמר בשמן למנחות שצ"ל נאה ומובחר שיש מהדרין ומהדרין מה"מ וכו' עד חמש פעמים כנגד ה' מעלות שיש בשמן (מנחות פו, ב) - וכן בשאר המצות שהעירותי עליהם במכתב הקודם. וכמו שנאמר במנחות שמצד החיוב להביא מן המובחר נתחייב תיכף בשמן שאין למעלה הימנו אם רק ישנו תח"י, כמו"כ גם בהא דב"ק אם חפצו לקיים ציווי דהתנאה לפניו במצות הנה תיכף נתחייב - אליבא דמערבא משמי' דר"ז - בהיותר נאה שמוצא גם אם הוא יותר משליש - (משא"כ בנ"ח, שאם רצונו להדר אין לחייבו לעשות דוקא כמהדרין מה"מ, כיון שהוא סוג אחר במקיימי מצות).
כי פשיטות הלשון בב"ק משמע דמערבא משמי' דר"ז מחלקים בין שליש ליותר משליש לענין אם פורעין לו בחייו או לא, אבל לא בענין החיוב. וכ"מ גם ל' הרשב"א הובא בשט"מ.
וצ"ע דמשמע קצת בפי' הר"ח שגם לענין החיוב מחלק.
והא שבפי' הר"ח בב"ק הביא ברייתא דנ"ח, אין הכרח לומר שדעתו גם בב"ק הוא ענין דמהדרין מה"מ (וכמו שא"א לומר כן אליבי' דפי' השני שבר"ח שמפרש "משל הקב"ה" אם הרחיב לו הקב"ה בממון)
אלא כוונתו להביא סמוכין עוה"פ בש"ס לענין הדור מצוה.
ולע"ע, לא ידעתי בש"ס בבלי עוד מקום הובא הלשון דהדור מצוה לבד מהנ"ל (אף שלפרש"י אחד הוא עם התנאה לפניו דשבת קלג, ב).
ב) מה שנסתפק אם בגמ"ח כשעור אדם אוכל פירותיהן בעוה"ז כו' או דוקא במהדר - יעוין קדושין (מ, א) מוכח כסברא הראשונה.
ג) מה שר"ל דאכילת פירות בעוה"ז אחד הוא ממש עם "משל הקב"ה" (וכנראה הכריחו לפי' זה תוד"ה משל - ב"ק שם).
לכאורה עכצ"ל דאינו כן, ויש בזה מה שאין בזה:
א) אכילת פירות בעוה"ז אינו דוקא באותו דבר גופא, ולדוגמא: אם ע"י כבוד או"א הי' לו חסרון כיס, לא מצינו הבטחה שימלא הקב"ה חסרון זה, דאכילת הפירות דכבוד או"א הוא "למען ייטב לך" סתם,
- ועובדא דדמא בן נתינא (קדושין לא, א) דלשנה האחרת קיבל ממון שהפסיד אינה ראי' שתמיד הוא כן, כיון דקרא דלמען ייטב לך סתמא כתיב -
משא"כ בהדור מצוה דמשל הקב"ה, היינו שממלאין לו ממון שהוציא (וע"ד הוצאות שויו"ט ות"ת דבניו ביצה טז, א) וכפשיטות הל' בש"ס.
ב) מכאן ואילך משל הקב"ה אין במשמעו אלא פרעון בעוה"ז כמה שהוציא, מילוי חסרון,
משא"כ אכילת פירות דמתני' דפאה אשר בגמ"ח כתיב - ימצא חיים צדקה וכבוד ועד"ז בשאר המצות, היינו פירות מרובים שלא בערך לגבי ההוצאה.
ואם נאמר שבהנ"ל מוכרח בפי' אכילת פירות ומשל הקב"ה, ע"כ צריך לדחוק בכונת תוד"ה משל (ב"ק ט, ב) דאין ר"ל דמשל הקב"ה אוכל כו' היינו מכוון ממש להא דמתני' דפאה,
אלא דבא לומר דמילוי מה שהוציא הוא רק פירותיהן אבל הקרן קיימת לו לעוה"ב, או שבא לשלול פי' הב' שהביא בר"ח דמשל הקב"ה היינו אם עשיר הוא ולא קאי בשכר המצוה. ומשתמש התוס' בל' המשנה ע"ד שמצינו במשנה משתמשין בל' הכתוב (פאה פ"ב מ"ב). וכמובא בס' כללי הש"ס.
ולהעיר אשר ע"י פי' זה בדברי התוס' יתורצו שתי קושיות:
א) בקידושין (מ, א) איתא דאין פירות אלא למצות שהוא טוב לבריות ובהידור מצוה דאתרוג וכה"ג אינו אלא טוב לשמים.
ב) אלו דברים שאדם אוכל פירותיהן דוקא הוא ומידי אחרינא לא, כדאיתא בשבת (קכז, א) וקדושין שם, ואין הידור מצוה יותר מכשליש - בכלל.
