I am responding to your letter, in which you ask me about the excerpt[1] of the sicha* of Shabbos Mevarchim[2] Elul, in which it is said that there were arei miklat* wherever Jews were found, both in the desert and "on the other side of the Yarden*, outside Eretz Yisroel." You ask me whether "on the other side of the Yarden" and "outside Eretz Yisroel" must be read separately or whether the two expressions designate one and the same place[3].
Here is my answer.
You will note that the text, as corrected by me, says: "or in the desert, or in Eretz Yisroel, or further on the other side of the Yarden, outside Eretz Yisroel." If "outside Eretz Yisroel" were to be read independently, it would have been necessary to put a fourth "or."
I mean to say that the other side of the Yarden is indeed outside Eretz Yisroel. You will consult, in this regard, the Sifri* on Parshas Masei, the Rambam, beginning of ch. 8 of Hilchos Rotzeach, and the Kesef Mishneh, ibid., who, according to one explanation, interprets the Sifri as alluding to outside Eretz Yisroel. It is therefore indeed thus that one must define the other side of the Yarden.
In your letter, you wonder about the Sifri. Why does it need to include the cities that were on the other side of the Yarden through an interpretation of the verse, when the verse mentions them by name? In fact, the Tosefta, in the second chapter of Tractate Makkos, deduces from this that if these cities are destroyed, others can be built. It seems to me that the Yerushalmi gives the same explanation, but I do not have it. Furthermore, if it is impossible to rebuild these cities in the same place, one can do so elsewhere. And one deduces from the interpretation of this verse that they must, in any event, be located "on the other side of the Yarden."

במענה על מכתבו, שבו העיר במ"ש בקטע השיחה של ש"מ אלול אשר ערי מקלט היו בכל מקום שהיו יהודים, הן במדבר והן "בעבר הירדן אין חו"ל", ושואל הכוונה אם עבר הירדן וחו"ל הם שני ענינים, או שעבר הירדן הוא חו"ל.
מענה :
כשיראה בהנוסח, שהוגה על ידי, הנה כתוב שם "סאיי אין מדבר, סאיי אין ארץ ישראל, סאיי אין עבר הירדן אין חוץ לארץ", ואם הי' ענין חו"ל סוג רביעי, הי' כתוב גם בזה התיבה "סאיי".
וכוונתי היא, שעבר הירדן (לגבי ארץ ישראל) היא חו"ל. ועיין בספרי פ' מסעי, וברמב"ם הלכות רוצח רפ"ח, ובכ"מ שם שלתירוץ אחד מפרש לשון הספרי שכתוב שם חו"ל, שעבר הירדן לגבי ארץ ישראל חו"ל קרי לו.
ומה שהקשה במכ' על הספרי, למה לו לרבות מהכתוב תהיינה, ערי עבר הירדן, כיון שמפורשים הם בכתוב. י"ל ע"פ המבואר בתוספתא (פ"ב. וכ"ה גם בירושלמי כמדומני, כי אינו תח"י) דמכות, שאם חרבו ערים אלו, בונים אחרים, ואם אי אפשר במקומם אז בונים גם במקום אחר , וילפינן מתיבת תהיינה, שצריכים להיות עכ"פ בעבר הירדן...
