To the great Rav, distinguished Chassid who fears Hashem and devotes himself to communal needs, Rav Asher[1],

Greetings and blessings,

You informed me that, on the 8th of Elul, the child Mordechai Ze'ev, son of Reizel and Rav Chaim Schneur Zalman[2], turned three years old. I therefore express my brachah* that his parents raise him to Torah, chuppah*, and ma'asim tovim*, with abundance.

Here is what my father-in-law, the Rebbe, wrote concerning the first haircut at age three:

"The cutting of the hair occupies an important place among Jewish customs. It has essentially the purpose of teaching the child that he must not cut his pe'os*. From this day forward, one accustoms the child to wearing a tallis katan*, to saying the morning brachos*, the brachah after the meal, and the Shema Yisroel* at bedtime.

May Hashem help you and you shall raise him to Torah, chuppah, and ma'asim tovim, in opulence, abundance, and tranquility of mind, materially and spiritually."

I conclude by addressing to you my brachah that you be inscribed and sealed for a good and sweet year,

P.S.: You write to me that you do not know whether one can fulfill the mitzvah of the arba'ah minim*[3] in your country, the authorities having decided that all fruits imported into Australia without authorization from the sanitary services must be destroyed. In this case, an official takes the initiative of handing them over to you, for the duration of the festival, but you must return them to him at its conclusion, so that they be burned.

This practice has always been in force, and you fear that this fruit, having to be destroyed by a decision of the authorities, is without value and therefore cannot be used, despite the arrangement consented to by the official.

Time does not permit me to answer you at length, but, in my opinion, there is no reason to be concerned about this. I shall give two reasons:

A) The prohibition is connected to the place and not to the esrog*. According to the same principle, one questions whether it is possible to recite a brachah on an esrog in the Beis HaMikdash*, where it is forbidden to consume food that is not consecrated. Now, at first glance, the Mishnah* suggests that one indeed recited the brachah of the esrog and the lulav* in the Beis HaMikdash.

Indeed, such an esrog is in no way forbidden for consumption. It is simply forbidden to take, inside the Beis HaMikdash, foods that are not consecrated to Hashem. And, it is the same regarding our concern. Such an esrog must in no way be burned. Nevertheless, Australia has decided that it should be, in the absence of sanitary authorization.

B) It is quite clear that this esrog retains a financial value, from various points of view. Indeed, if the one who possesses it decides to leave Australia, he will not be prevented from taking it with him.

It is the same for the permission to eat it. If, from the moment of importation of the esrog, a man wished to destroy it by eating it, he should be able to do so, if he assumes responsibility for his own state of health.

שלום וברכה!

במענה על הודעתו אשר ביום ח' אלול נמלאו שלש שנים להילד מרדכי זאב בן ריזל בנו של בנ"ח מו"ה חיים שניאור זלמן שי', הנני בזה להביע ברכתי שיגדלוהו הוריו לתורה לחופה ולמעשים טובים מתוך הרחבה.

וזה לשון כ"ק מו"ח אדמו"ר זצוקללה"ה נבג"מ זי"ע מה שכתב בענין התספורת לשלש שנים:

"... ובדבר גזיזת השערות - אפשערענעס - הוא דבר גדול במנהג ישראל, ועיקרו הוא בהחינוך דהשארת פיאות הראש, ומיום הגזיזה והנחת הפיאות של הראש נהגו להדר להרגיל את התינוק בענין נשיאת ט"ק וברכות השחר וברכת המזון וק"ש שעל המטה, והשי"ת יהי' בעזרם שיגדלוהו לתורה לחופה ומעש"ט מתוך פרנסה בהרחבה ובמנוחת הדעת בגשמיות וברוחניות".

נ"ב: במה שהעיר במכ' שנסתפק אם יוצאים במדינתו במצות ד' מינים, כיון שהמלכות גזרה שכל פרי הבא לאוסטראליא בלי תעודת בריאות, מחרימים אותו, ורק שהפקיד נוהג מעצמו היתר למסור להבעלים על ימי החג ע"מ שיחזירו לו אחר החג לשריפה, ונוהגים שם היתר בזה מקדמת דנא, וחושש הוא שכיון שמצד גזירת המלכות הפרי אסור באכילה, ומחוייבים לבערו מן העולם, ורק שהפקיד עושה לפנים משוה"ד, וא"כ אין כאן לא דין ממון ולא היתר אכילה.

הנה אין הזמן גרמא להאריך בזה, אבל לדעתי אין כאן מקום לחשש, ואזכיר רק שנים מהטעמים:

א) שאין האיסור על האתרוג כ"א האיסור הוא על המקום. דוגמא לדבר אם מותר לברך אתרוג בבית המקדש, כיון ששם אסורים באכילת חולין, אשר משטחיות לשון המשנה משמע בברור שהיו מברכים אתרוג ולולב גם במקדש, והטעם כי אין הענין שהאתרוג אסור באכילה, אלא שבביהמ"ק אסור לאכול חולין. ועד"ז הוא גם בנדון דידן, שאין האתרוג חייב שריפה אלא שבמדינת אוסטראליא אסור להשהות פירות מחו"ל בלי תעודה.

ב) ברור הדבר שיש כאן דין ממון, לכמה וכמה ענינים, ומהם שאם בעל האתרוג חפץ לצאת לחוץ מדינת אוסטראליא, הרי בודאי לא יפריעו בעדו לקחת האתרוג עמדו, והוא הדין בענין היתר אכילה, שאם תיכף בהבאת האתרוג להמדינה ירצה האדם לבערו ע"י אכילה, לכאורה ברור שירשו לו, אם יקבל ע"ע האחריות בעד בריאותו.
