To the distinguished Rav...

I greet you and bless you.

I have received your letter, to which was attached a dollar and your complaint that you are being bothered by being sent books.

There was no intention of bothering you. Do our Sages not say that all Jews are holy? It was clearly stated in the letter accompanying the book that you could return it if it did not satisfy you, for any reason whatsoever.

Basing myself on the teaching of our Sages, I am returning to you, enclosed, your dollar. As for the Kuntres Umaayan, there is no need to return it. You may keep it. It was sent graciously to several people. I am convinced that if you consult this book, you will find it of interest. In any case, it has no need of my recommendation.

I was very surprised by your letter. Regarding the sending of books, you cite references in the Torah and in the Shulchan Aruch*. For the latter, you are undoubtedly alluding to the following paragraph: "It is forbidden to ask the borrower to repay when one knows that he is not in a position to do so. In such a case, the creditor must not even appear before him, for as soon as he sees him, he is humiliated, knowing that he cannot pay him."

Concerning the Halachah, your words are, in my humble opinion, very surprising, and I would like to develop my point on this subject. Several points you advance arouse my surprise:

A) The verse of the Torah you cite prohibits putting the lender in difficulty. But this verse, like the Shulchan Aruch we have just cited, applies only when one knows that he is incapable of paying. This is what the Talmud and the Poskim* indicate.

Must the creditor who is not certain that this man can repay him refrain from claiming the debt, giving the benefit of the doubt? The Minchat Chinuch* indicates that the formulation of the Shulchan Aruch does not allow one to affirm that this is the case. How much more so in our situation [1].

B) What is even more surprising in your reference to this Halachah of the creditor is that it is stated only in the case of a loan.

Now, this situation is very different. On one hand, the one who has contracted a loan is indebted to the one who rendered him a service. One must then take into account human personality.

Moreover, a man cannot be brazen before the one who lent him money and did him good. This situation has an effect on the manner of claiming the debt and the humiliation that may result.

Furthermore, the one who contracts a debt has an obligation to repay it, which obviously has nothing to do with our case.

Moreover, Tzedakah is a Mitzvah but does not have an obligatory character like the repayment of a debt, which is incumbent even on one who lacks the means. Conversely, one who has no means to assure his sustenance is not required to give Tzedakah. In any case, one cannot have the role of creditor when it comes to Tzedakah. This term is, certainly, employed figuratively by our Sages, but this provision does not come from the Torah. Moreover, it is used only when someone demands that he be given Tzedakah, as the Rambam* and the Shulchan Aruch specify. It is, however, forbidden for the creditor to appear before the one who owes him money (...).

C) The Talmud and the Poskim establish that it was customary, when one wanted to sell merchandise, to offer it from house to house. No one challenges such a practice, especially when this sale is made by correspondence and not orally. It is then easier to refuse.

Our practice therefore cannot in any way be challenged.

הרה"ג הוו"ח אי"א חו"ב נכבד ונעלה...

שלום וברכה!

נתקבל מכתבו בצרוף דולר אחד, ומתאונן על אשר מעיקים בשלוח ספרים וכו',

והנה לא היתה כלל כוונה להעיק וידוע מארז"ל (חולין ז, ב) ישראל קדושים הן יש רוצה כו' - וכמו שכתוב בפירוש במכתב הנשלח ע"ד הספר אשר כל אחד יכול להחזיר הספר אם מאיזה טעם שיהי' (עיין סוטה מד, א. לפיכך תלתה תורה כו') אינו רוצה בו.

ומוסג"פ הדולר חזרה, עפמ"ש בחולין שם. הקונטרס "ומעין" אינו צריך להחזיר לנו וישאר אצלו - ולכמה אנשים נשלח הוא מבלי כל דררא דממונא - ובטוח אני אשר אם יעויין בו ימצא בו דברי חפץ וכו' ולא להסכמתי הספר זקוק.

והנה ביותר נפלאתי על מכתב כת"ר, כי ראיתיו מציין - לענין שילוח הספרים - לקרא ולשו"ע חו"מ סי' צ"ז, וכנראה כוונתו לסעיף ב' וז"ל שם אסור לנגוש את הלוה לפרוע כשיודע שאין לו ואפילו להראות לו אסור מפני שהוא נכלם בראותו למלוה ואין ידו משגת לפרוע.

ובאשר נגע בענין דינא, ולפענ"ד דבריו תמוהין ראיתי להאריך קצת בבירור הדבר.

והתמי' בדבריו היא מכמה טעמים:

א) קרא - דלא תהי' לו כנושה - והשו"ע הוא דוקא כשיודע שאין לו, וכל' הש"ס והפוסקים.

ואם המלוה מסופק אם יש ללוה אם שייך בזה לומר סד"א לחומרא כבר העיר במנחת חנוך (מצוה סז) דמלשון השו"ע (חו"מ סצ"ז ס"ב) משמע דאין כאן איסור כלל, ועיי"ש טעמי' דמסתבר, ועל אחת כו"כ בנדון דידן,

ב) מה שתמוה עוד יותר במה שציין לדין דאסור לנגוש כו' הוא דדין זה לא נאמר אלא בלוה ומלוה.

והחילוק פשוט: הן מצד הנוגש - דעבד לוה לאיש מלוה (עיין רמב"ן עה"ת שמות כב, כד) וע"ז נאמר הרכבת אנוש (ב"מ עה, ב)

ויש לצרף גם הא דאין אדם מעיז פניו בפני בעל חובו ע"פ גי' רש"י (ב"ק קז, א) שהוא מפני שעושה לו טובה דזה שייך גם להנגישה והכלימה -

הן מצד הענין - דמחוייב לשלם לו - משא"כ בנדון דידן דלא שייך כל זה, ופשוט.

ולא עוד אלא אפילו אדצקה דיש כאן מצוה - אף שאין החיוב בזה כמו החיוב דפרע"ח, דשם גם אם אין ידו משגת בכ"ז יש עליו החיוב גם בשעה זו, משא"כ בצדקה דאינו חייב בצדקה אם אין לו פרנסה - עיין טוש"ע יו"ד ר"ס רמ"ו וסי' רנ"א ואכ"מ - אבל בצדקה דאין הענין דעבד לוה גו' לא קאי אצדקה הדין דלא תהי' לו כנושה, וכדאי' בב"ב (ח, ב) דהוצרכו לקרא דופקדתי על כל לוחציו, ואינו אלא מדברי קבלה ולא דאורייתא, וגם האיסור זה בצדקה אינו אלא כשתובעו, וכמ"ש הרמב"ם הל' מתנות עניים פ"ז הי"א, והועתק בשו"ע יו"ד רמ"ח ס"ז, משא"כ בלוה דאפילו להראות לו אסור.

ועפי"ז מובן בפשיטות הא דירוש' הוריות (פ"ג ה"ד) מעשה בי' ר"א כו' וראה רבותינו ונתייאש מהן עלה לו לביתו כו' דלכאורה קשה הם לא היו צריכים להראות לפניו, דמדסיים שם ונתפללו עליו משמע דידעו דירד מנכסיו.

ויש לדחות דאולי לא ידעו דאין ידו משגת כלל ובפרט לגירסת דב"ר פ"ד ס"ח דאיתא שם א " ל התפללו עלי, אבל מל' הפוסקים הדין ברור דאינו אלא בתובעו וכ"ש בנדון דמכירה, ואעכו"כ כשמודיעין מתחלה שבידו שלא לקנות.

ג) בכמה מקומות בש"ס ופוסקים מוכח, דאחד מדרכי מכירת סחורה הי' ע"י שהיו מחזרים בבתים עם סחורתם (ב"ב כב, א ועוד) ואין פוצה פה ומפקפק כלל וכלל, ואעכו"כ כשהוא ע"י כתב המוכר ולא ע"י פיו דאז קליותר להשיב פניו, דאין מקום כלל לפקפוקים .
