To my friend, refined and scholarly man, who disseminates the Torah,

Rav Sh. [1],

I greet you and bless you.

You are questioning regarding the question posed by the Kuntres Umaayan, of the Rebbe Rashab*, at the end of chapter 17. This text highlights a contradiction between the statement of our Sages according to which man's material sustenance is decided between Rosh Hashanah* and Yom Kippur*, and the Talmudic passage that says man is judged daily. You write to me what a scholar asked you in this regard:

A) Rabbi Yossi*, according to whom man is judged every day, is an isolated opinion. All the other Sages do not share his view and consider that he is judged on Rosh Hashanah.

B) The Mikraei Kodesh*, of Rav Yosef of Amiga, explains that according to Rabbi Yossi, nothing distinguishes Rosh Hashanah from all the other days of the year, from the standpoint of judgment. However, the festival of Rosh Hashanah was established to encourage men toward daily Teshuvah, regardless of the day.

C) Why does the Kuntres Umaayan not say that this contradiction has already been highlighted by the Mikraei Kodesh?

It seems to me that one can give the following explanation on this matter:

A) It is clear that if the Halachah* is not decided according to the opinion of Rabbi Yossi, the fact that man is judged every day does not pose a problem for us. For Rabbi Yossi himself, however, the question remains. What is the purpose of the judgment of Rosh Hashanah, since man is judged daily?

But it is surprising that this question was asked, since the Kuntres Umaayan itself provides the answer. I quote: "We must understand the explanation of our Sages according to which a man is judged every day. Is it not said that his material sustenance is decided on Rosh Hashanah? And Rabbi Yossi himself, who considers that man's judgment is daily, nonetheless acknowledges that there is another judgment, pronounced on Rosh Hashanah."

The Likkutei Torah* is more precise: "Only Rabbi Yossi and Rabbi Natan consider that man's judgment is daily, while the other Sages do not share this view. Nevertheless, Rabbi Yossi and Rabbi Natan also acknowledge that the judgment takes place essentially on Rosh Hashanah. Similarly, our Sages say that man's material sustenance is fixed between Rosh Hashanah and Yom Kippur, which seems to be the unanimous view, but these Sages nevertheless consider that man is additionally judged every day."

Furthermore, the one who questioned you considers it obvious that the Halachah is decided according to the view of the Sages, against that of Rabbi Yossi. This is indeed what the Mikraei Kodesh says, but one may ask whether this is truly the case, for the contrary seems more likely. A principle establishes, indeed, that when the Sages of the Gemara* discuss the opinion of a Sage of the Mishnah*, they consider that the Halachah should retain that opinion. Now, in this case, Rav Chisda [2] indeed comments on the opinion of Rabbi Yossi [3].

And one cannot object that several Sages of the Gemara also discuss the opinion of the Sages of this Mishnah. Indeed, they do not comment on their opinion, but merely ask how judgment is rendered on high. What they say is also conceivable according to the opinion of Rabbi Yossi. Furthermore, those who consider that a verdict rendered on an individual cannot be reversed, thus opposing Rabbi Yitzchak, are of the same opinion as Rabbi Yossi, considering that one prays for the sick and for those who are weak, as the tractate Rosh Hashanah indicates.

It is difficult to think that all pray only for the sick and the weak. Especially since the question posed by the Gemara is "how do we pray at the present time?" — and one sees clearly that it concerns everyone. Similarly, in the tractate Nedarim*, Rava does not envisage that according to the Sages one can pray only for the sick and the weak. One can, however, object that in this latter case, this idea is mentioned incidentally, but is not the actual subject of this passage.

Remark: No proof can be drawn from the principle according to which the Halachah follows the opinion of Rabbi Yossi when he disagrees with his colleagues, even if one limits its application to the case where he opposes only one colleague and not several. Indeed, in the present case, each of these colleagues has a different opinion and must therefore be considered as an individual opinion. The tractate Eruvin*, which reports a discussion between Rabbi Meir, Rabbi Yehuda, and Rabbi Yossi, allows us to establish that this is indeed so.

This does not apply in our case, because the name of the author of the Mishnah is not indicated. It therefore expresses the view of the Sages, which is retained by the Halachah.

B) The Mikraei Kodesh considers that according to Rabbi Yossi, man is judged every day in a manner strictly identical to Rosh Hashanah. Certainly, Rosh Hashanah is the day of remembrance, but every day of the year is equally so. He develops a lengthy analysis on this matter. But although he considers that the Halachah is not decided according to the opinion of Rabbi Yossi and Rabbi Natan, one may ask how, according to him, these Sages could hold such a view. The Likkutei Torah insists on this aspect, and does not the Zohar* call Rosh Hashanah "the day of the great judgment"? How can one imagine that Rabbi Yossi, who was a disciple of Rabbi Shimon Bar Yochai*, held a different position?

Moreover, the Zohar also insists on the definitive verdict pronounced on Hoshanah Rabbah* and Rabbi Yossi is one of those who give explanations on this subject. How would the author of the Mikraei Kodesh explain such a contradiction?

C) Why does the Kuntres Umaayan not mention the question posed by the Mikraei Kodesh? Because it is based on the writings of the Ari Zal* and the teachings of Chassidut*. It therefore does not aim to cite all references dealing with this subject. And it cites the Asarah Maamarot* only to find support for the interpretation of this Talmudic passage according to Rav Huna and Rabbi Yossi, without challenging the opinion of the Sages, since no real controversy opposes them insofar as each develops a different idea.

Another question was posed to you regarding the introduction of the Kuntres Umaayan. This introduction reproduces a letter explaining that when the 19th of Kislev* was proclaimed the Rosh Hashanah of Chabad Chassidut, it was said: "Chabad is, thank Hashem, alive and well, and may Hashem revive Chagat [4]." You were asked how it was conceivable to express oneself thus regarding Chagat, the initials of Chesed*, Gevurah*, and Tiferet*, Sefirot* that belong to the domain of holiness.

It is quite evident that the term Chabad* here designates the Chabad Chassidim, whose service of Hashem is based on reflection and understanding, leading to the love and fear of Hashem. These Chassidim were strengthened by the dissemination of this letter, and that is why it says: "Chabad is, thank Hashem, alive and well." And the term Chagat designates the Chassidim of the Polish schools, who serve Hashem by attaching themselves profoundly to the Tzaddik*, who arouses in them the love and fear of Hashem. It seems to me that the question posed concerned only the formulation.

In fact, we find its equivalent in the words of our Sages. The Zohar gives another reading of the verse "you shall perform them" [5], which is the following: "You shall make Me" [6], and it explains: "I consider you as if you had made Me." Now, the introduction of the Kuntres Umaayan employs an expression strictly identical regarding the Sefirot.

A similar formula is found in the revealed part of the Torah. The tractate Berachot* reports: "The Holy One, blessed be He, said to Moshe: You have comforted Me with your words." And the commentators explain extensively what constitutes an act of divine service performed for Hashem.

This idea is briefly explained in Chassidut, based on the introduction of the Ranach to the Pri Etz Chaim*, which says: "There is a profound aspect to each Sefirah, which adds nothing and takes away nothing from its function, from Keter*, the heavenly crown, to the lowest level. The actions of men, good or bad, have no effect at this level. The profound state of these Sefirot cannot be modified thereby. Certainly, the accomplishments of men reveal light in the heavenly spheres and bring about an immense transformation, much more important than the original state, to the point that the profound aspect is practically negligible when compared to this contribution."

Various texts explain that certain Mitzvot are linked to the head of the King, others to His body, others still to His hand. And the one who uses his intellect to understand the Torah awakens the heavenly Attributes of intellect.

The revealed part of the Torah alludes to this, which says that a scholar, when he studies the Torah, finds himself facing the Holy One, blessed be He, Who studies it with him.

In the same manner, the one who awakens in his mind the love and fear of Hashem, or who renders a service to another, awakens the heavenly Attributes of emotion, Chagat, in which he reveals an increased Light, as we have said.

Such is the meaning of this Chassidic expression mentioned in the introduction of the Kuntres Umaayan. For "if they are not prophets, they are at least children of prophets," and when one studies the Torah, in particular its profound aspect, "Chabad is alive and well" here below, in the one who dedicates himself to this study. Consequently, the Light that surrounds the worlds grants increased vitality to the heavenly Attributes of intellect. And those of emotion, Chagat, which one awakens in one's mind, also bring a more intense Light to the heavenly Attributes of feeling.

Since we are discussing the Mikraei Kodesh, I would like to point out to you a surprising fact that I saw in the chapters we have just cited.

In chapter 11, this work insists on the idea that the luminaries were suspended on the fourth day of creation. They were then at the gate of heaven, in the same manner as the vegetation. It was only when man was created, on the sixth day, that they began their functioning and rotation. That is why the Rosh Chodesh* of the month of Tishrei is fixed on the sixth day of creation and not the fourth.

I regret to say that all of this is very surprising. Indeed,

A) The blessing of the sun, pronounced when "one sees the sun in its time and the moon in all its strength" [7], is indeed said on Wednesday and not on Friday. And if this is the opinion of Rabbi Yehoshua [8], one can deduce that it is also that of Rabbi Eliezer, according to whom the world was created in Tishrei.

B) The Mikraei Kodesh itself specifies that the luminaries were created on the first day. He considers, however, that they were set in orbit only on the sixth day. If so, why did the moon accuse the sun on the fourth day, when the luminaries were suspended? She should have done so at their creation [9] or when they began to function [10]. And one cannot say that the moon initially asked not to be in the same heaven as the sun. If such were the case, why would it have been necessary to reduce her circumference [11]?

C) The Targum Yerushalmi indicates that the sun and moon were identical for one hour minus 672 Chalakim* [12], according to a calculation established by the Asarah Maamarot. Now, the question previously posed is raised once again here. This count should be established from when these luminaries were created [9] or from their coming into function [10], but not from the instant they were suspended in the heavens.

D) It is said that according to the sages of Egypt, the sun was created first, under the constellation of the lion, for fifteen Chalakim. The moon was then created, for fifteen Chalakim as well, under the constellation of the crab. It therefore took the moon, to arrive at the Molad* [13], when the sun and moon are under the same constellation, two and a quarter days, during which the moon traverses 30 degrees, from the crab to the lion.

Thus, it is clear that the luminaries began to function from the instant of their creation. This is not, however, the opinion of the Tosafot*, according to whom the count must be distinguished from the actual functioning.

I have not found, for the time being, an explanation in the words of our Sages justifying the view that the luminaries were created on the 15th of Av, but why multiply controversies among the Sages and imagine that they also diverge on the fact that the luminaries were set in orbit from their creation?

In any case, I have difficulty understanding the opinion of the author of the Mikraei Kodesh. Do we not have the merit of possessing the writings of the Ari Zal? Now, the Etz Chaim* says: "On this fourth day, the luminaries were complete. Then, on the fourth day, the accusation of the moon was made and she had to be diminished accordingly. Afterwards, on the sixth day, she began to grow and reached perfection, until Adam committed the sin." The esoteric dimension thus allows us to establish the plain meaning, which conforms to it. Chassidut also explains this reduction of the moon.

במענה על מ"ש ע"ד הקושיא המובאה בקונ' ומעין - לכ"ק אדמו"ר נ"ע - מתחיל מסוף מאמר יז - בסתירת מרז"ל שאמרו (ביצה טז, א) דמזונותיו של אדם קצובים לו מר"ה ועד יוהכ"פ ובר"ה (טז, א) אמרו שאדם נידון בכ"י, וכותב שהקשה לו גדול א':

א) הלא ר' יוסי, שהוא האומר אדם נידון בכ"י, הוא יחיד, ורבנן פליגי עלי' וס"ל דנידון בר"ה.

ב) בספר מקראי קדש לר' יוסף מאמיגה (ח"ב ס"י ואילך) מסיק דבאמת לדעת ר"י אין חילוק בין ר"ה לשאר ימות השנה לענין הדין , ורק שר"ה נקבע להזכיר ולעורר את בנ"א לעשות תשובה בכ"י ויום בלי הבדל בין יום ליום.

ג) תמי' מפני מה לא הוזכר בקונטרס ומעין שבס' מקראי קדש מפלפל ע"ד סתירה הנ"ל.

ומה שנראה לי בכ"ז:

א) גם א"ת דאין הלכה כר"י, ולכן, לדידן , ל"ק מהא דאדם נידון בכ"י הרי בכ"ז לר' יוסי הקושיא במקומה עומדת: מהו ענין דין דר"ה כיון דנידון בכ"י.

ופליאה על המקשה שעמד ע"ז, כיון דבמקומו גופא מבואר כן בקונט' ומעין, וז"ל: צ"ל משארז"ל אדם נידון בכ"י ואיך יתווך זה עם מאמר הנ"ל דמזונותיו קצובין לו מר"ה כו' דודאי גם ר"י שאמר דאדם נידון בכ"י מודה דהדין ומשפט הוא בר"ה כו'. וביתר בי' בלקו"ת ס"פ קרח, דכתב: והגם שמה שאמרו אדם נידון בכ"י זהו דברי ר"י ור"נ משא"כ לרבנן, מ"מ הא ע"כ גם לר"י ור"נ עיקר הדין בר"ה, דאל"כ כו' וכן מרז"ל מזונותיו של אדם קצובים לו מר"ה ועד יוהכ"פ משמע דאתי ודאי לכ"ע ואין בזה שום מחלוקת, ואעפ"כ ס"ל דאדם נידון ג"כ בכ"י עכ"ל.

נוסף על הנ"ל: מה דפשיטא לי' להמקשה דאין הלכה כר"י כ"א כרבנן - וכ"כ בס' מקראי קודש ח"ב רפי"א דהלכתא כרבנן - צע"ג, דאדרבא איפכא מסתברא - דהלכה כר"י, והוא א) ע"פ הידוע בכללי הש"ס דאם אמוראים שקו"ט בסברת תנא אחד ש"מ דהלכה כמותו, ורב חסדא (ר"ה טז, א) נושא ונותן לפרושי דברי ר"י, ואין לסתור מהא דכמה אמוראים שקו"ט (ר"ה יח, א) בדברי רבנן במתני', דשם אינו שייך לדעת רבנן, כ"א באופן הדין למעלה, וגם אליבא דר"י שייך פירושם. ב) כל אלו דס"ל דגז"ד של יחיד אינו נקרע, (עיין ר"ה יז, ב ונדה ע, ב) ודלא כר' יצחק, ע"כ דס"ל ג"כ כדעת ר' יוסי, כיון דמצלינן אקצירי ומריעי, וכאי' בר"ה (טז, א), - ודוחק גדול לתרץ דכולם לא היו מתפללילם אקצירי ומריעי, ובפרט שבש"ס אומר בפשיטות כמאן מצלינן האידנא, משמע שכו"ע היו עושין כן, ועיג"כ בנדרים (מט, ב) דרבא לא קאמר אי בעית אימא דמצלינן אקצירי ומריעי גם אליבא דרבנן (אף דיש לדחות דשאני התם שלא הובא ענין זה אלא דרך אגב).

הערה : אין להביא ראי' דהלכה כר"י מהכלל דהלכה כר"י מחבריו, וגם אם נאמר דהוא דוקא מחברו ולא מחבריו (עיין תוד"ה כרבי עירובין מו, ב וד"ה בשעת שם פו, ב וכבר האריכו בזה בספרי כללי הש"ס), הרי כאן כיון דכאו"א מחבריו יש לו דעה מיוחדת חשובים כיחידים כדמשמע בעירובין (מז, א) דפליגי שם ר"מ ר' יודא ור' יוסי.

דאינו - דכיון שהוא מחלוקת בברייתא וסתם במתני' - כרבנן - הרי הלכה כסתם (יבמות מג, ב).

ב) מה דמסיק בס' מקראי קודש (ה"ב פי"ב) דר"י (ומכ"ש ר"נ) ס"ל "דאדם נידון בכ"י כמו בר"ה בלי שום הבדל כו' לא שהוא יום דין שמאר ימות השנה, ומה שאנו אומרים..

בריות בו יפקדו.. הכוונה שביום זה יפקדו וכן בכל שאר הימים" והאריך בזה, הנה אפי' שטתו דאין הלכה כר"י ור"נ, צע"ג איך אפ"ל דר"י ור"נ ס"ל כן, וכמו שהקשה בלקו"ת (שם), ובפרט אחרי האריכות בזהר בענין ר"ה איך שהוא יומא דדינא רבה כו', ור' יוסי שהי' מהחברייא דרשב"י, איך יחלוק על כל זה,

וביותר קשה מזח"ג (לא, ב ולב, א) דהאריך שם בענין פתקין דהו"ר ובענין ריח וגם ר' יוסי בין המדברים, ואיך יפרנס בעהמ"ס מק"ק סתירה מפורשת כזו.

ג) מפני מה לא הזכיר בקונ' ומעין דבס' מקראי קדש מפלפל בסתירה הנ"ל, הנה בקונטרס זה בא לברר הענין ע"פ יסודות כתהאריז"ל ותורת החסידות, ואין מענינו להביא כל מקום שמדבר שם עד"ז, ומה שהביא ס' עשרה מאמרות הוא לסיוע שיש לפרש בסוגיין דר"ה דר"י ורבנן לא פליגי ומר אומר חדא ומר אומר חדא.

עוד הקשה לו במ"ש במבוא לקונטרס ומעין (דף 25 עב) אשר בהתפרסם אגה"ק ע"ד יט כסלו שהוא ר"ה לחסידות חב"ד אמרו "חב"ד ב"ה לעבט און הש"י זאל געבען אז חג"ת זאל זיך אפלעבען" והקושיא איך אפ"ל על חג"ת, ספי' קדושות, ל' כזה.

והנה בודאי גם להמקשה פשוט דכוונת האומר היא על חסידי חב"ד - שסדר עבודתם להשכיל ולהתבונן כו' (ועי"ז באים לאהוי"ר) שנתוסף בהם חיזוק וחיות ע"י פרסום אגה"ק זו, וזהו "חב"ד ב"ה לעבט", ובאמירתו חג"ת נתכוון לחסידי פולין, שסדר עבודתם באמונת צדיקים (ואשר הצדיק ישפיע בהם) ואהוי"ר. וכנראה קושיתו היא על ביטוי הלשון לבד.

אבל באמת הנה כבר מצינו עד"ז שאמרז"ל (זח"ג קיג, א) ועשיתם אותם אתם כתיב מעלה אני עליכם כאלו עשאוני וממש כל' הנ"ל במבוא אבל בנוגע לספירות , הוא גם בגליא דתורה בברכות (לב, א) חי אני כו' שא"ל הקב"ה למשה משה החייתני בדבריך, וכבר האריכו עד"ז בספרים (והובאו כמה מרז"ל בזה) בביאור הענין דעבודה צורך גבוה (עבוה"ק בהקדמה ותחלת חלק העבודה, של"ה בהקדמה דרוש שער הגדול ועוד).

והענין - בקיצור - מבואר בדא"ח ע"פ הקדמת מהרנ"ש לפע"ח וז"ל (בהנוגע לכאן) דיש בספירות בחי' עצמם - ולא תחסר ולא תעדיף איש איש במדרי' ועבודתו, מן הכתר העליון עד סוף כל המדריגות, ובענין זה אין להם חלק בתחתונים כלל אם יטיבו או יריעו שהחוק הקבוע לא יושבת, אמנם ע"י עבודת התחתונים יוסיפו אור מלמע' ויזדככו זיכוך רב, ותהי' ההוספה הזאת מרובה על העיקר כו'. עד שלא יחשוב קצבתם הקצובה אליהם בערך התוספת ההיא (עיין לקו"ת שה"ש ד"ה להבין ענין הטעם למה שהאתעדל"ע).

והנה מבואר בכ"מ אשר יש מצות תלויין ברישא דמלכא ומנהון בגופא ומנהון בידוי כו' (זח"ב פה, ב, ת"ז תי' ע' דף קל, א ועוד) וכשמתמש בשכלו שבנפשו להשכלה והבנה בתורה זהו תלוי במוחין דלעילא.

וכנרמז ג"כ בגליא שבתורה דאמרז"ל (תדב"א ח"א פי"ח) כל ת"ח שיושב ועוסק בתורה ושונה הקב"ה יושב כנגדו קורא ושונה עמו.

וכן כשמעורר אהוי"ר בנפשו או שעושה חסד כו' תלוי בחג"ת עילאין, לענין התוספת אור וכנ"ל.

וזהו לשון חסידים המסופר במבוא, דאם אינם נביאים בני נביאים הם, שע"י העסק בהשכלת והבנת התורה ובפרט פנימיות התורה איז חב"ד לעבט למטה באדם הלומד, ועי"ז ממשיך מאוא"ס הסוכ"ע אור וחיות בחב"ד דלמעלה (לקו"ת שה"ש ד"ה לסוסתי - השני) וע"י העבודה בחג"ת שבנפשו ממשיך ג"כ למעלה בחג"ת תוספת אור.

ואגב דאתי' לידי ס' מקראי קודש רציתי להעיר בדבר תמוה שראיתי בפרקים הנ"ל והוא

בפי"א שהאריך במסקנא שביום ד' נתלו המאורות ועמדו על פתח הרקיע (כמו הדשאים) ורק בבריאת האדם ביום הששי התחילו לשמש ולהתנענע ולסובב ולכן אז נקבע לר"ח תשרי ולא ביום ד'.

והנה אחרי בקשת סליחה וכו' זהו תמוה ביותר א) לית דין צריך בושש דברכת החמה דרואה חמה בתקופתה ולבנה בגבורהת הוא ביום ד' ולא ביום וא"ו (ברכות נט, ב) ומדר' יהושע נדע גם לר"א דאמר בתשרי נברא העולם. ב) כיון שנבראו המאורות ביום א' - וכמ"ש גם בס' מק"ק - והתחילו לסובב ולהאיר על הארץ - לפי דעתו - רק ביום וא"ו, א"כ למה קטרגה הלבנה ביום ד' כשנתלו בשמים ממנ"פ או שהי' לה לקטרג תיכף לבריאתם או כשהתחילו לשמש ולהאיר (ואין לתרץ שמתחילה אמרה שלא יתלו ברקיע אחד - חגיגה יב, ב - דאם באופן זה לא איכפת לה, א"כ למה נזקקו למיעוט הירח). ג) בת"י (בראשית א, טז) דהיו השמש והירח שוין בכבודם כ"א שעה חסר תרע"ב חלקים (דיוק משך זה דוקא נתבאר בס' עשרה מאמרות מאמר אכ"ח ח"א סי"ד, ודלא כהגהת הרד"ל) וגם בזה הקושיא כנ"ל דממנ"פ אית לי' לחשוב או משעה שנבראו או משעה שהתחילו להאריר אבל לא מעת שנתלו ברקיע ד) איתא בברייתא דשמואל רפ"ו חכמי מצרים אמרו תחלת בריאת המאורות חמה נברא בארי' בט"ו חלקים לבנה בסרטן בט"ו חלקים כו' נמצא חדשה של לבנה (עד המולד שאז השמש והירח במקום אחד במזלות) כו' שני ימים ורביע (שבמשך זה הולכת הלבנה ל' מעלות שמסרטן עד ארי'. עיין הל' קדה"ח להרמב"ם פי"ד) - משמע להדיא שתיכף לבריאת המאורות התחילו לסובב בפו"מ (משא"כ בתוד"ה לתקופות - ר"ה ח' ע"א - דאינו אלא לחושבנא אבל אינו מוכרח לומר שהי' הסיבוב בפו"מ.

וכמו מולד בהר"ד שהוא מולד תוהו ולא שהי' בפו"מ). ואף דלדעת ח"מ הנ"ל דבט"ו באב נבראו המאורות לא מצאתי, לע"ע, חבר במקום אחר בדרז"ל אבל מה לן לאפושי פלוגתא ולומר דגם בסיבוב המזלות תיכף לבריאתם פליגי.

סוף דבר דעת בעה"מ לא זכיתי להבין ומשזכינו לכתהאריז"ל נתבאר בע"ח ש' מיעוט הירח פ"ב וז"ל: ואז - ביום ד' - נגדלה כל ג' בחי'.. עד שתהי' בחי' פרצוף גמור, וכאשר הירח קטרגה אז נתמעטה וענין מיעוט הירח הי' ביום ד' אח"כ ביום וא"ו חזרה להתגדל בבחי' הג' הנ"ל היותה פרצוף שלם (עד שחטא אדה"ר) ומן הסוד נדע ע"ד הפשט כי מתאימות המה. עניןמיעוט הירח ע"פ דא"ח עיין אור התורה - להצ"צ פ' בראשית וש"נ.
